(a) Account means a unique account created for You to access our Service or parts of our Service.

Welcome to BISJHINTUS JOB PORTAL (hereinafter referred to as the "Site" or as "BISJHINTUS" interchangeably), These terms and conditions of use ("Terms") constitute a legal agreement between the company/employer/users and M/S BISJHINTUS PRIVATE LIMITED, Use of this Site constitutes your unconditional acceptance of these Terms herein and by all terms, policies and guidelines incorporated by reference. These Terms apply to your use of this Site and do not alter in any way the terms or conditions of any other agreement you may have with its subsidiaries or affiliates. (Here in the company/employer/users is referred to as “you”);

If you are using the Site on behalf of any entity, you further represent and warrant that you are authorized to accept these Terms on such entity's behalf, and that such entity agrees to indemnify BISJHINTUS JOB PORTAL for violations of these Terms. If you do not agree with these terms, please do not use this Site. You are entering into this contract with BISJHINTUS JOB PORTAL (also referred to as “we” and “us”) (https://jobscorporate.bisjhintus.com).

3) GOVERNING AND APPLICABLE LAWS


Any disputes relating to this agreement shall be governed by the laws of India, and M/S BISJHINTUS PRIVATE LIMITED and the user hereby submit to the exclusive jurisdiction and venue of the courts located in Mangalore (Karnataka). Any other venue to which any party may be entitled by virtue of domicile or otherwise is waived by both parties.


4) OBLIGATIONS

4.1 Service Eligibility

To access or use this service of BISJHINTUS JOB PORTAL, you must be at least 16 years of age or older, the age of majority in your jurisdiction, otherwise you may not use these services. An employer and its authorized agent(s) are permitted to use the employers free employer account and any data about that employer provided via that account for the employers internal business purposes. Except as set forth above, BISJHINTUS JOB PORTAL, or as otherwise approved by us, BISJHINTUS JOB PORTAL, is for your personal, non-commercial use unless you enter into a separate agreement with us for your commercial use. you may not use BISJHINTUS JOB PORTAL if we have terminated your account or banned you.

As between you and others (including your employer), your account belongs to you.

You are okay with us providing notices and messages to you through our websites, apps and contact information. if your contact information is out of date, you may miss out on important notices.


5) USE OF PROHIBITED ACTIVITIES


We want people to use our platform freely, but not at the expense of other people's safety and well-being or the integrity of our community. You, therefore, agree not to engage in the conduct described below.

1) You may not use our job portal to do or share anything:


  a) That breaches these terms (privacy policy and cookies).

b) That infringes or breaches our rights including our intellectual property rights.



2) You may not access or collect data from our website using automated means (without our prior permission), nor may you attempt to access data that you do not have permission to access.


3) Attempt to probe, scan or test the vulnerability of a system or network..


6) INDEMNIFICATION


You agree to defend, indemnify and hold BISJHINTUS JOB PORTAL, its subsidiaries, affiliates, licensors, employees, agents, third party information providers and independent contractors against any claims, damages, costs, liabilities, and expenses (including, but not limited to, reasonable attorneys' fees) arising out of related to any User Content that you post; store or otherwise transmit on or through the Site, your conduct, your use or inability to use of the Content, or your violation of any rights of another;

7.1 Posting jobs on BISJHINTUS JOB PORTAL


  You may not post any job ad that:


a) Contains false information or solicits employees by intentional misrepresentation, such as, misrepresentation of the terms of employment, the hiring entity, or the identity of the poster.


b) Requires an application fee or up-front or periodic payments; requires recruitments of others; resembles a multi-level marketing scheme, franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement; or only pays commissions (except where the listing makes clear that the available job pays commission only and clearly describes the product or service that the job seeker would be selling); or resembles a multi-level marketing scheme.


c) Involves any screening requirement where such screening requirement is not an actual and legal requirement of the advertised position.


d) Contains any logo or brands, or link to a website, other than your own or those of any entity for which you are authorized to submit job ads.


e) Contains multiple job openings in a single job ad (unless you've purchased a service that permits this);


f) Discriminates against applicants on the basis of gender, race, religion, sexual orientation, age, disability, or any other ground(s) prohibited by applicable law, in each case as determined in BISJHINTUS JOB PORTAL's reasonable discretion.


You agree that BISJHINTUS JOB PORTAL may, at its sole discretion, remove or prevent the posting of any job ad for any or no reason.


7.2 Reviews on BISJHINTUS JOB PORTAL

You may not offer incentives in exchange for company or interview reviews. You may not trade reviews with other employers. We will remove reviews where we have evidence that users were compensated to leave reviews.

You may not coerce employees to leave reviews. Coercion includes asking employees to provide proof to an employer that they wrote a review whether or not that proof includes the content of the review itself.

7.3 Communications with Job Seekers

We may inform a user when you have taken an action with respect to the information, we have shared with you on behalf of that user, such as when you open the user's application, view their resume, view their profile on BISJHINTUS JOB PORTALS and/or make a decision about their application. When you view, store, or receive materials through your use of BISJHINTUS JOB PORTAL, we may use such materials for data analysis, quality control, or to refine our platform and services. We may also share with our users our observations based on such data analysis. For example, we may tell our users which employers are more likely to open applications submitted to BISJHINTUS JOB PORTAL, which employers are active on BISJHINTUS JOB PORTAL, and how long certain aspects of the candidate process take on average for a given employer. We may, on your behalf, send out reminder emails to Job Seekers you wish to interview. BISJHINTUS JOB PORTAL may also send emails to Job Seekers on your behalf indicating that your job posting is potentially a match for the Job Seeker’s resume. You understand and agree that BISJHINTUS JOB PORTAL may take such actions.

8) PROVISIONS FOR APPLICANTS:-

These Terms, specifically for Applicants, are in addition to the other generic Terms & Conditions listed on the page which are common to all the users of the site and which you are required to go through. Any violation of these T&Cs may result in, but not limited to, an applicant's Job application being declined and/or his/her account being permanently blocked and/or suitable legal action being initiated against him/her by BISJHINTUS.

1. If you have applied for a Job on BISJHINTUS JOB PORTAL and received a communication from the employer regarding your application, you must respomd to it with-in 72 hours.

2. Once you accept a job offer, you must make every possible effort to join and start the job on time. To not show up or to decline an earlier accepted job offer at the last moment, or your lack of communication creates a very poor impression of you in front of the employer and reduces your chances of getting hired. any such behaviour will also result in your account being blocked on BISJHINTUS JOB PORTAL and we will also report it to your college administration wherever applicable.

3.You must provide accurate and complete information at time of applying for job application or for creating an account on BISJHINTUS JOB PORTAL - any misrepresentation of infomation, or concealing any material infomation, or impersonation would result in your account being blocked on the site.

4.You must pay attention to a job's complete details (profile, location, remuneration, skills required, etc.) before appllying for it.

5.You are strictly prohibited from transferring/selling/sharing Employers data (contact deatails, etc.), for free or for a fee, with any other entity. Any such attempt would result in your account on BISJHINTUS JOB PORTAL being permanently blocked and would be liable for legal action against you

6.BISJHINTUS community is a community of sincere users who are known for and are expected to demonstrate high standard of professionalism and ethics in their dealings with others users - you are required tomaintain these standard and decorum of the community. All your communication with BISJHINTUS should be professional and must not contain any obscene or offensive content.

7. If you come across any suspicious activity, content or behaviour on BISJHINTUS JOB PORTAL by another user, you must report it to BISJHINTUS immediately so that necessary actions can be taken - this os both your duty and obligation.

8.While we make our best efforts to bring you the current job opportunities available, BISJHINTUS JOB PORTAL, does not guarantee a Job selection to the candidate.

9.Upon registration, your registered email ID and phone number will be automatically subscribed to receive email and SMS notifications from BISJHINTUS JOB PORTAL. You may opt out of it anytime.

9) Third- party content on BISJHINTUS JOB PORTAL

Content from other users, advertisers, and other third parties is made available to you through BISJHINTUS JOB PORTAL ``Content" means any work of authorship or information, including salaries, company reviews, interview reviews, company photos, logos, employer responses, job ads, employer profile information, advertisements, comments, opinions, postings, resumes, messages, text, files, images, photos, works of authorship, e-mail, data or other materials you find on BISJHINTUS JOB PORTAL. Because we do not control such Content, you understand and agree that:-

 1. We are not responsible for and do not endorse, any such Content, including advertising and information about third-party products and services, job ads, or the employer, interview, and salary-related information provided by other users.

2. we make no guarantees about the accuracy, currency, suitability, reliability or quality of the information in such Content.

3. we assume no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful Content made available by users, advertisers, and third parties.

C) If you are a parent or legal guardian of a minor, you hereby agree to bind the minor to these terms and to fully indemnify and hold harmless the company if the minor breaches any of these terms. 14) TERMINATION:-

14.1 You are free to stop using our service at any time. We reserve the right to suspend or terminate your access to the service with notice to you if: -

B)  Your use of services would cause a real risk of harm or loss to us or other users, or
